Who can seek asylum?
Any individual who has been in the United States for less than one year and can demonstrate a credible fear of persecution can apply for asylum through the U.S. Citizenship and Immigration Services Agency. More specifically, individuals must meet the criteria of the U.S. Refugee Act which states in part:
“Any person who is outside any country of such person's nationality or, in the case of a person having no nationality, is outside any country in which such person last habitually resided, and who is unable or unwilling to return to, and is unable or unwilling to avail himself or herself of the protection of, that country because of persecution or a well-founded fear of persecution on account of race, religion, nationality, membership in a particular social group, or political opinion.”
Additionally, there are provisions for forced sterilization and forced termination of pregnancy as grounds for asylum applications.

How can a person apply for asylum?
Individuals who meet the criteria can apply for asylum by going to the U.S. Citizenship and Immigration Services Agency and completing an I-589 form. Additional resources can be found at the Asylum Law Consortium.

How can the Atlanta Asylum Network help?
Once an individual has completed the I-589 form and contacted an immigration lawyer, we can arrange for a medical and/or psychological evaluation. Interested individuals should have their lawyers complete the INTAKE FORM. If you are unable to identify a lawyer, please contact us. We strongly encourage asylum applicants to contact us after identifying a lawyer and prior to his/her initial meeting with the immigration officer. However, clients can also contact us after their cases have been referred to a judge.
